Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using the MailPilot platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation, and the terms “you” and “your” shall refer to that organisation.
If you do not agree to these Terms, do not use the Service. MailPilot, Inc. (“MailPilot”, “we”, “us”, or “our”) reserves the right to update these Terms at any time. Continued use after the effective date of any revision constitutes acceptance.
2. Description of Service
MailPilot is a B2B email deliverability platform that provides:
- Automated mailbox warm-up via a managed sending network
- Inbox placement monitoring across major email providers
- Spam pre-flight analysis before campaign dispatch
- Sender domain authentication guidance (SPF, DKIM, DMARC)
- Reputation repair workflows for degraded sending domains
The Service is provided on a subscription basis. Feature availability varies by subscription tier as described on our pricing page.
3. Acceptable Use
You agree to use the Service only for lawful purposes. The following are expressly prohibited:
- Spamming: Using MailPilot infrastructure to send unsolicited bulk email, phishing messages, malware, or any communication that violates CAN-SPAM, GDPR, CASL, or equivalent anti-spam law.
- Credential abuse: Connecting mailboxes you do not own or have explicit written authorisation to operate on behalf of a third party.
- Reselling without permission: Reselling, sublicensing, or white-labelling the Service to third parties without a signed reseller agreement with MailPilot.
- Platform abuse: Reverse-engineering, scraping, or attempting to circumvent rate limits, access controls, or security measures.
- Misrepresentation: Impersonating another person, organisation, or MailPilot itself.
Violations may result in immediate account suspension without refund and may be reported to relevant authorities.
4. Account Responsibilities
You are responsible for:
- Keeping your login credentials confidential and not sharing account access with unauthorised parties.
- Providing accurate, current, and complete account information and keeping it up to date.
- All activity that occurs under your account, whether or not authorised by you.
- Notifying MailPilot immediately at security@mailpilots.in upon discovering any unauthorised use of your account.
5. Subscription and Billing
Access to paid features requires an active subscription. Subscriptions are billed in advance on a monthly or annual cycle. By subscribing you authorise MailPilot to charge your payment method on file via our payment processors (Stripe / Razorpay).
No refunds for partial months. If you downgrade or cancel mid-cycle, you retain access to your current tier until the end of the paid period. Fees already charged are non-refundable except where required by applicable law.
Upgrades take effect immediately and are prorated. Downgrades take effect at the start of the next billing cycle.
MailPilot reserves the right to change pricing with 30 days’ notice. If you do not accept a pricing change, you may cancel before the new price takes effect.
6. Data and Privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You own your data. MailPilot acts as a data processor on your behalf. We process your data - including connected mailbox credentials and warmup history - only to the extent necessary to deliver the Service. We do not sell your data or use it to train AI models.
7. Intellectual Property
MailPilot and its licensors own all right, title, and interest in the platform, including all software, algorithms, interfaces, documentation, and trademarks. These Terms do not grant you any right to use MailPilot branding or intellectual property except as strictly necessary to use the Service.
You own all content you upload to or generate through the Service, including your email templates, sending domain configurations, and reports. You grant MailPilot a limited, non-exclusive licence to process that content solely for the purpose of delivering the Service.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
No guarantee of inbox placement. MailPilot applies best-practice warm-up strategies and provides placement monitoring to maximise your deliverability. However, inbox placement is ultimately determined by receiving mail servers and recipient engagement. MailPilot does not guarantee that any email will reach the inbox, and deliverability outcomes may vary.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAILPILOT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
MAILPILOT’S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO MAILPILOT IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Termination
Either party may terminate these Terms at any time. You may cancel your account from your dashboard settings. MailPilot may suspend or terminate your account immediately for material breach of these Terms, including violations of the Acceptable Use policy.
Upon termination, your right to access the Service ceases immediately. You may request deletion of your data by emailing privacy@mailpilots.in. All personal data will be deleted within 30 days of such a request, except where retention is required by law.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property infringement or breach of confidentiality.
